DMCA Policy
Verdacert LLC (“Verdacert”) respects the intellectual-property rights of others and expects users of the Services to do the same. This Policy describes how to submit a notice of claimed copyright infringement under the U.S. Digital Millennium Copyright Act (17 U.S.C. § 512), how to submit a counter-notice, and how we handle repeat infringers.
1. Designated DMCA agent

Our designated agent’s information is also on file with the U.S. Copyright Office. Notices sent to any other address or channel may be ignored.
2. Notice of claimed infringement (takedown)
To be effective, your notice must comply with 17 U.S.C. § 512(c)(3) and include substantially the following:
- a physical or electronic signature of a person authorized to act on behalf of the owner of the exclusive right that is allegedly infringed;
- identification of the copyrighted work claimed to have been infringed (or, if multiple works at a single online site are covered, a representative list);
- identification of the material that is claimed to be infringing or to be the subject of infringing activity, and information reasonably sufficient to permit us to locate it (URLs are best);
- your contact information, including name, mailing address, telephone number, and email address;
- a statement that you have a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law; and
- a statement that the information in the notice is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
3. Counter-notification
If you believe material you posted was removed or disabled by mistake or misidentification, you may submit a counter-notice under 17 U.S.C. § 512(g) that includes substantially the following:
- your physical or electronic signature;
- identification of the material that was removed or to which access was disabled and the location at which it appeared before removal or disablement;
- a statement under penalty of perjury that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification;
- your name, mailing address, telephone number, and email address, and a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or, if your address is outside the United States, for any judicial district in which Verdacert may be found), and that you will accept service of process from the person who provided the original notice or an agent of that person.
After we receive a valid counter-notice, we may restore the material in 10–14 business days unless we first receive notice that the complaining party has filed an action seeking a court order against you.
4. Misrepresentation
Under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material is infringing, or that material was removed or disabled by mistake or misidentification, may be liable for damages, including costs and attorneys’ fees. Do not submit a notice or counter-notice if you are unsure whether your claim is meritorious — consult a lawyer first.
5. Repeat-infringer policy
Verdacert maintains a policy of terminating, in appropriate circumstances, the accounts of users we determine to be repeat infringers. We may also remove material, suspend accounts, or take other action where, in our discretion, we believe a user has otherwise violated intellectual-property rights, even absent a formal DMCA notice.
6. Non-DMCA intellectual-property claims
For claims of trademark infringement, right-of-publicity violations, or other intellectual-property claims, please email legal@verdacert.com with a detailed description of the claimed violation and the material at issue. We address such claims promptly but do not apply DMCA procedures to non-copyright claims.
